    NDC Status update

    I saw on NDC that my status has changed from J-READY FINAL DISBURSEMENT to K - Discharge Pending, just wondering how long your Discharge took once the status changed to Discharge Pending?

    I think ours was right around 30 days, but we had to ride the lawyers behind to file the paperwork with the court after we saw that on NDC. It's a separate process. You have to file the motion for discharge and make sure you have turned in your debtor education certificate. If you see both those docs on pacer you should be good to go. Then it's "Welcome to the discharge club"!

      I'm not sure what is going on with ours. Notice of Cure was the last thing to arrive and that was May 1. Nothing else happened except payments sent from the employer, but then they paid the current mortgage payment at the end of May. I believe they have everything. Is there a way I can tell if they are missing something? How can they audit when they just sent the mortgage company a check? It has said "closing soon" since at least April. There is an entire month's of payments just sitting there. They made payments to creditors at the end of April which I assume is the final payments since nothing but current mortgage was done at end of May. I notice that they took the trustee fees in May so they get to collect as long as they drag this out? As there certain times when discharge is more likely to occur like the first week or last week of the month? Total paid to all parties seems to be a little more than our payment times 120. Could that be causing a delay?

        We have our finance management class done. Today NDC says notice of completion filed dicharge pending. Nothing on Pacer yet i will check again at the close of the business day. Hopefully 30 more days!!!!

        Frustrated51 I know how you feel! I don't know why there is such a delay try to call the trustee. The process sucks no notification from lawyer, i have to bug her.... i know we had over $3000 over payment in our account everything was paid. during the final distribution of payment they paid our mortgage for June and paid all of the creditors extra $$. NDC says we are getting over $1000 back. YesterdayNDC said dicharge pending today says notice of completion filed discharge pending, because of advice from bk fourm it probably will be 30 days for my discharge.

          Same here, my last payment is in a couple weeks...NDC it says Z- Closing soon, since March, I also have as of May, had paid ALL creditors, there are zero balances in the ledger. I will pay June as it is the 60 month, but I do not owe any creditors. I also have money in the account besides the money I pay for June..How long does it take to finalize the amount I will get back? Thanks..NDC will tell you what u are getting back?

            It showed all my creditors were paid too! We had a balance over $3,000 after my closing date 5/29 NDC said J-READY FINAL DISBURSEMENT then it disbursed payment to my mortgage, trustee, all creditors (who had 0 balances) and says I am getting a refund. Today it has a $0 balance and NDC says Notice of Completion Filed Discharge Pending. Hoping for discharge in 30 days....

                The thing about NDC is that each Trustee uses it differently. It is not an official record of the court. It is the Trustee's tool for managing the BK estate. You can't rely on anybody else's experience with NDC statuses to determine what you will see unless they have the same trustee. For example, in NDC, my case went from "about to close" to "completed" after I made my last payment and has not changed since then, even now that I am discharged. There was never a "ready final disbursement" or "discharge pending" or other statuses others have mentioned.

                Below is what was filed in my case beginning 7 days after I made my payment in mid April. I copied this from PACER and edited it to remove dates and names and to show who filed each document if it wasn't already clear. It seems pretty typical as far as what has to happen between the final payment and the discharge in a case where there was no arrears on secured debt being paid. But, timing will vary. My discharge happened very quickly in comparison to what others report. 60 to 90 days seems to be more the norm.

                The certificate of mailing filed on day 14 was for the documents filed on Day 10. Creditors had 21 days after day 14 to object to discharge based only on the contents of the documents filed on day 10. Note that the documents filed on Day 40 are required to get the order voiding the lien on my second mortgage. In my court, that is done after discharge. I don't think that is true in all courts.

                $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

                  My NDC account remained active until my discharge. Pacer is where I was able to see the status of my discharge. As long as you remain under $15 in fees per quarter it is free.

                    This is very helpful. Thank you. I am not seeing any of that on mine though and our last payment should have been the one at the end of April. Last Pacer comment is the Cure document from the mortgage company. I am discouraged! I would like to do a mortgage modification which will require court approval if done before discharge and I don't want to delay discharge for that. Will have to resubmit all my paperwork if we can't do it within the next two weeks.
