    ch 13 - discharge timeline

    Hello everyone! I am new here and waiting for my Chapter 13 to be discharged but I get different answers from my lawyer and trustee. I live in Michigan and my chapter 13 closed on 5/12 (its been a long 5 years) just got a letter on 5/26 saying my payments no longer need to be deducted from my paycheck. Does anyone know how long it will take to get a discharge now? Will i get the discharge before my case is officially closed? All i wanted was a timeline but can't get a straight answer.

    Also I am selling my house do I just need the discharge or do i have to wait until my case if completely closed....

    Any help would be helpful

    It really varies....I'm 95 days after last payment and the audit isn't even done, so I have AT LEAST 30 more days, whereas LITR was discharged 36 days after her last payment.....hard to say....I'm out of my mind with the wait at this point.....

      Wow! That scares me. I hope you get a discharge soon! I wish they would explain the process in more detail! We have done everything we needed to do. Everytime I talk to my lawyer i get a different timeline. Trustee clerk told me she is done on her end and I should get something this week. Keeping my fingers crossed. GOOD LUCK TO YOU!         Every district is different, but hopefully someone from yours comes on to share their experience.

          Yes, it really varies by the court. It sounds like in your court, it may even vary by case. Everything in my court seems to go quicker than in most courts. I was surprised at how quickly I received my discharge. It seems that a majority of Chap 13 debtors have to wait at least 60 days for their discharge and often longer.

          Discharge comes before the case is closed. I am guessing that you saw your case closed on NDC or 13network. That means the trustee has closed out your case in his/her records, but it doesn't mean that the Court has closed your case.

          Hang in there! You've done the hard part and completed the plan. Your discharge will come!

          Technically, I am pretty sure you need authorization to sell your house until the case closes. But, getting authorization should be pretty simple at this point. Ask your attorney to be sure.

            I just saw in 13network that my case said J-READY FINAL DISBURSEMENT, does anyone know what that means?

              It means that the trustee is ready to make final payments to your creditors.
