    Question on declaration of support ?

    Can I separate from a spouse between last payment and final discharge ? By separate I mean move out at minimum but possibly file a legal separation also .

    When I read the declaration I believe it's for court ordered alimony only.

    The declaration for a domestic relations order or domestic support order (DSO) -- which are orders of the court. If you just separate and there is no alimony (or something in the nature of support) then you would not have any DSO declaration. Additionally, you should probably ask your attorney additional questions if there is going to be any distribution of property as you may need relief from the automatic stay.

      Only BK asset to split is the house which now has equity. Other checking , pensions etc not part of BK

        Every Chap 13 debtor must sign the DSO declaration to get a discharge. If you are not under a DSO order, you check the box saying you so.
