    Bank Charged off debit on 2/28 and I have no proof for March 7th filing

    When I was advised to put my money in another bank I had a loan balance from check protection through my bank and the attorney told me to put it on the creditor list, that it would be a preferential payment if I paid it.

    Well, now that I finally filed I have to have statements from all banks from 3/7. I tried to get into the old account and it wouldn't let me in. Said to call the bank. When I called the bank, they had been bought out and the woman in collections told me my account had been charged off Feb 28. But she couldn't get into my account either and they 'normally' send a letter saying they were closing the account. I never received the letter from them stating this.

    I do have a call into the law office to see what they suggest. Unfortunately, my lawyer is on vacation until the 14th and the law clerk who is helping is out until Monday. I left emails for both of them and I'm sure they will get back to me but I am panicking now as I can't even remember if I got February's statement from them. I'll look through all the piles but... Just hope this doesn't screw up my case!!

    I will also call the bank tomorrow if I can't find February's statement but has anyone else ever encountered something like this? If so, what did you do?

    Well, apparently no one has been in this situation. I tried to call the bank Friday and no one in collections answered the phone. Called back to customer service and they sent me (again) to collections and lo and behold, guess they don't work on Fridays - or at least they don't answer the phone there. So, will just have to wait for my lawyer on Monday.

    The entire debit to the bank is $350 ($300 + fees) so I can't see where the trustee would worry about it but....just wish I knew.

      Can you pull up a credit report and see if it is listed there?

      We have an overdraft protection account with our CU, which we reaffirmed along with our car loan. We stayed with the CU, so can't help with the closed and bought out bank situation.

      Do you have any of your old statements at all?

        Thank you. The law firm did pull a report when I hired them so will have to look at that. When I did get ahold of the bank on Thursday, she said she didn't think they'd reported it yet. I did give the statements for the past 7 months to my lawyer. I was hoping that would be enough but the law clerk (who was also not there Friday) said I had to contact the bank and get something from them.

        I'm going to ask them (lawyers office) to help me because I think that since I quit paying last June and the bank showed a consistent balance due (except the fees increased) it should fly but I don't know. I will bring it up to them on Monday. After all the work preparing for the bk, this is just frustrating and worrisome.

          What really angers me is that I wanted to pay them and the 1st lawyer I saw (who I did not pick) told me I HAD to quit paying on the loan as it would be considered preferential. At that time I hadn't found this forum and knew nothing. I wish now I'd gone with my gut instincts and paid it off as it took me another 8 months since I saw that lawyer before I finally interviewed others and picked a different one. The loan would have been paid off by then.

            UPDATE - Lawyer says I did all I could and to just bring my last statement to the 341 meeting and explain that they said they'd charged it off. Won't be a problem as it is a consistent charge from when I stopped paying them.

            Also said the trustee is a really nice guy so my case should be a walk in the park. Whew - I hope so!
