LOL - Okay, let me 'splain. I swear he was my Grandfather reincarnated. When our group was called in, he was eyeing me immediately because he could probably tell I was nervous. He was stern with people, but often was just pulling their leg. Everytime he made a wise crack he looked over at me to see if I was laughing (I was!)
So our turn came, and he swore us under oath. Name, occupation, what is your annual salary. . blah, blah, blah. He asked where I work, and I told him the name of the law firm I work at. He asked who I work for, I told him the name, and of course he knew him. (I know this had to help me - I work for one of the nicest guys on the planet) He got to the question of "have you given anything to anyone in the last 4 months" to which we both said no. He asked the question again - we looked at each other, puzzled, and said no again. Then he asked, "have you had a cold in the last 4 months that you may have given to someone?" I think that's what he was getting at. LOL
Then came the hiccup. If anyone is reading this - learn from me. He asked us about our bank accounts, to which my husband told him about all 4. He asked if we pay any service charges on these accounts, and we said yes. He asked why we don't close some of them. Then my husband told him that we opened one in "his name only" because a creditor was suing me and we didn't want them to freeze our joint account. I think this angered the Trustee. He said, "do you realize that any attempt to fraud a creditor out of bank account funds could lead to dismissal of your bankruptcy case?" HUH!?!?! It was NEVER our intent to defraud anyone - my intent was to PROTECT MY MONEY. God knows I have bills to pay and we need to eat. If a creditor had "frozen my account," we would literally be hungry. I told him that was not my intent, and that they were about to garnish my salary but we filed bankruptcy just in time. He said, "well you taught THEM a lesson, didn't you!" And he smiled. Then he told me to ask "Mr. __________" (one of the attorneys I work with) about attempting to defraud a creditor by changing bank accounts." I told him I would. OOOPS!
He did NOT ask about a tax refund this year. He did NOT ask about bonuses. He did NOT ask about when we thought there would be a change in employment. Actually, there were probably a million questions I was worried about that he never asked. Thank God.
When we filed our Ch. 7, we were $135 over passing the Means Test. My husband is on unemployment. Our Attorney is under the impression that we will not be going to the US Trustee because they would have already heard by now. Wow. . . pretty easy. I think the hardest part may have been driving in the blizzard to get there - but we were there an hour and a half early. LOL My husband wanted to kill me.
