    Unknown Creditor

    Hi All!

    Our 341 is scheduled for September 3rd. I logged onto PACER tonight and was shocked to see American Express Travel Related Services as a creditor. ( There is an attorney representing them with an office in Malverne, PA). Neither I nor my husband has ever had an American Express Card!! How do you think this creditor got listed? Do you think he will be coming to the 341? We haven't got a clue!!

    I had a couple of creditors show up on my credit report that I never had an account with. My attorney went ahead and listed them just incase. Some of the collection agencies could be representing one of your creditors. That may be where the information is coming from. I would not worry about them showing up at the 341 meeting. Most of the time creditors do not show up at the 341 meeting.

      Thank you for the quick reply. I am really starting to get stressed out about this 341 and I know that I shouldn't!! We filed pro se (so no attorney involved) but I think you are probably right about this attorney representing one of our creditors; I believe it might be Wells Fargo.

        Unless you have some reason to be worried(like fraud) then chances are no one will be at your 341 meeting. I was worried that Best Buy was going to come after me for the laptop I bought my daughter the year before or Value City Furniture for my bedroom set I had bought 9 months before but I never heard from any of them.

        Don't get yourself worked up. I'm willing to bet that you'll be just fine. After being at a 341 and seeing what other less deserving people were able to get away with, I felt much better my situation.

          Thanks for the words of encouragement! We have nothing to hide (mostly because we have nothing !!) so it should go okay. I checked the court calendar and we are the first case on the 341 docket!

            Particularly if you KNOW you never had an Amex card, there's just no way I'd worry about that.

                You'll do just fine then. Do your best to not even stress over it. You'll be here the next day telling us about how silly it was to get upset over it and how you walked out 5 minutes later

                        I'd kind of like to know the answer to that one myself...Who "deserves" bankruptcy ? And who doesn't ? It's a legal right we all have the option to exercise..Sounds kinda snobby..Going to go mingle with us "great unwashed" at the 341 ??

                          Go and hear some of the stories. The guy before me had just claimed bankruptcy almost 8 years to the day before this one. He had no house, only rented and had JUST bought a car with a $600/month car payment 2 months beforehand and of course tons of credit card debt as so many of us have/had. What baffled me is that the trustee didn't even question it and just said, "Ok, good luck" and sent him on his way. There were many cases like this. That's just one in particular.

                          We all know that there are people who find themselves in over their head and need bankruptcy and then there are people who abuse their right to claim bankruptcy.

                          That being said, my only point was that there are people in much worse situations(and sometimes even abusing their rights) than the original poster and therefore I'm sure she had nothing to worry about.

                            Speaking of who deserves and who doesn't deserve bk, as well as the "right" to judge others, it's the way the laws and system are set up. I personally don't think it (the law) is fair to not everyone but to many people who truly need bk. For instance, the other day I read a story from yahoo that a college graduate who majored in psychology owing $80K in student loans, currently working at a call center for $13/hour. She IS struggling to pay her debt, as chapter 7 bk won't wipe out her huge student loan. Other instances such as a real estate tycoon who owed $570 million and one auto mogul who owed $767 million, both filed for chapter 7 bk and STILL living a lavish lifestyle after filing for BK.

                              The back and forth on who deserves bk is interesting, but that is not the job of the trustee to decide, they are simply responsible for following the law. The law attempts to define that, but does so very crudely.

                              Anyone who is a serial filer, running up credit cards and repeat chapter 7 is hurting themselves, they don't get wealthy that way, they need a better plan.
