Timeline for notice of 341?

    Timeline for notice of 341?

    Anyone know if there is a timeline that directs the court to send out the notice of a 341 hearing within some specific count of days?

    I went to check my P.O. Box today and nothing. I filed Monday and somehow thought they'd have sent it by Thursday. Too eager beaver?

    I filed last Friday and just got mine today. So it may take a few more days for you to receive your notice.

      I'm such a wimp (albeit an "empowered" wimp, if you can imagine such a sorry being) that I've been pretending that if I ignore the fact that my district puts the docket of 341 meetings online for each month, maybe no one else will see my name there.

      So after I made that query earlier I remembered the docket postings, bucked up and went to the district website and checked the scheduled meetings for my name. Nothing yet.

      Perhaps it will take a few more days, as you say. I had hoped that I'd be fortunate and have it close to the 20th since I filed on the first, but it seems like the chances of that are zip nada nothing.

      How long are you waiting for yours?

        I did sign up for pacer last Friday, but my record didn't show up until Monday. It was strange to see so much private information online, but I just have to remember that I would have never known about pacer if I didn't file bk and I think most people only know about pacer if they have been involved in a bk case. Besides I like to think that people have better things to do than to surf through people's bk records! Maybe I am being naive, but it makes me feel better!

        As for finding your record, you may want to look at the national link for pacer (I think that is the link). I tried to pull up my information in my district and was unable to locate my information. I actually knew about my 341 date last Monday, but didn't get the mailing notice until today. Hope this helps.

          Thanks. After reading about some of the pitfalls of enlisting in Pacer, I decided that there was little reason for me to worry about it. Chapter 7 filings pass more quickly than Chapter 13 filings do. I don't want to get too obsessive, and I do tend to do so. I'll only worry about Pacer if there are issues I need to track; so far I don't anticipate any.

          You don't have to be in Pacer to read the docket in either district I've filed in. Unfortunately. At least with Pacer I know that people have to go to a certain amount of trouble to dig through stuff. But when they post the docket to the Internet, anyone who does a Web search on a name could end up with a link to the docket that shows their target as a bankruptcy filer.

          It feels like the public flogging component of the whole thing. I know bankruptcy is public. But it doesn't have to be that simple for people to find out. It would be nice if the docket information was on pages that at least included the HTML meta information to exempt them from search indexing. Maybe they are and I just don't know about it.

            I was concerned about having my info show up the internet, but from what I have read, pacer by itself is not indexed by any search engines. There is a 3rd party plugin, I think it is called Recap, that can cause it to be indexed. I don't know much about it, but given that I was only accessing it from my home computer, I wasn't worried about it. I just googled myself and nothing about bk comes up (granted it has only been a week). Come to think of it, when I was searching for information on bk not once do I remember anyone's case coming up, and I did a lot of research! So I don't think it will end up on the internet.

            I was also concerned about wanted to login every day and check my case, but I haven't. Once I found my record and printed out the documents, I haven't logged in since. I won't check pacer again until after my 341 where it will hopefully say no distribution and then I'll login at the 60 day discharge date. Other than that, I don't want to know what is going on! If there are problems, which I don't anticipate, then I'll hear about it from my attorney. So far this is working for me.

              So maybe your district doesn't put the 341 meeting schedule on their regular Internet website? That's where I'm not looking forward to having my name appear. I'm haven't been worried about information from Pacer leaking out into the regular Web environment, though perhaps I should be. But to see the names of people waiting for their 341 hearings to occur, all I have to do is go to my U.S. district court website and look around for the list of upcoming meetings. My name isn't there yet, but unfortunately I'm sure it will soon be.

              When they update the docket for the next month, this month's list will probably go away. It's those pages that I'm hoping are not indexed since search engines have a way of hanging onto things.
