    CH 7 Trustees in Oakland, CA

    Just wondering if anybody here had experience with the Chapter 7 Trustees in Oakland (No. CA District) that would be able to share. Thank you so much

    With regard to the 341 or in general?

    Either way, my Chapter 13 in CA went through the Northern District. The trustee maintained a mailing address in Memphis, TN for the mailing of installments on the payment plan. Her office was very cordial the few times I dealt with them -- they had a 510 area code and were probably in Hayward -- I did much prefer them to my attorneys for my to the extent that they were able to supply information. I don't know whether the dismissal of my case when I was unable to adhere to the payment plan came any sooner or later or was handled any differently than it would have been in another venue.

    I found the Chapter 13 341 painless after the hassle of dealing with the attorneys. But then my Chapter 13 was low on assets and I was fortunate enough to be called more or less last after everyone else had left the room -- what a relief! I doubt I'll be that lucky again for the Chapter 7 in my new state. There were no rude or inappropriate remarks so far as I recall, to anyone though the trustee did chide a few attorneys for a few things. I noted the presence of certain IRS agents who were waiting for some other people and would indicate that they would be waiting to speak with them outside after the proceedings.

    Let me know if there's anything specific. I don't know who many trustees there are or if I got the one of them.

    For the Oakland courthouse, you really do need to make sure you get there early -- the line at security can be long.
    11/2008 - Filed Chapter 13
    02/2010 - Chapter 13 dismissed
    08/2010 - Filed Chapter 7 pro se in new district
    09/2010 - Chapter 7 341

      Thanks empowered. To be specific, I was wondering how detailed or not the CH 7 trustees at that court tend to be during 341's.

      I know there is one female trustee who asks for a ton of docs prior to the 341, but never asks questions during the 341 related to any of the docs so it looks like she doesn't even look at them...lol.

        I had a female trustee and a few questions were asked though I don't remember them all. It went down really easy. I was asked to affirm the amount of the Chapter 13 payment that was agreed to in the plan. I was asked whether I had destroyed credit cards... It was the easiest piece of the whole thing for me.

        There were no great hassles with my paperwork that I ever heard about but my case was pretty simple.

        It probably took less than 5 minutes for each person to go through the process.

        08/2010 - Filed Chapter 7 pro se in new district

          Yeah, that's the expectation, but I'm kind of wanting to go overkill on developing realistic expectations. My guideline is "prepare for the worst, make sure you can live with the worst, therefore anything better than that is a friggin bonus!!!"
