    341 experience and observations

    We had ours the other day and it went by smoothly. (Ch 13) The Trustee only asked us a few basic questions and was very professional and courteous. Ours was a breeze BUT most of the cases before us had some kind of issue. It was very interesting!

    The one that sticks out the most is one couple (the least nervous in the room, all giggly and and talkative during the proceedings) had the most issues. They were trying to go for a 36 month, and 1-2 months prior to filing, they maxed out their 401K with-holdings, were paying $1500 for daycare (to her mom). The Trustee was not very happy with them and sent them back to the drawing board after telling them they can afford to pay much more and for longer.

    Another case was not recommended for approval because Trustee said that it was a 7 disguised as a 13 and he was tired of dealing with 7s.

    Btw, there were no creditors in the room for any of the cases that day. Quite a few people were wearing jeans, tank tops and flip flops, too. We dressed business casual. Even being in CA, I don't think it's appropriate to wear flip flops and tank tops in a courtroom.

    I had mine yesterday chapter 7 went very good for us,but the lady befores didnt bring her id no social security card and was missing one of her bank statments,i just don't ubderstand why people do these things to there self there told what to bring before hand,the trusty was not pleased.

      Just did my 341 recently and all went well. The trustee didn't ask for anything like stubs or statements and just asked the general 341 meeting questions. It didn't take more than five minutes total. My attorney was right there next to me just in case I stumbled. Now I'm in the 60 day club. I am hoping for the best.
