Our 341 was today and it went well....actually very well. This was the Western North Carolina Court. Everyone with Chapter 13 had to be there at 2, then the trustee got up and gave a talk about what was about to happen in the court room and details, rules, expectations, etc. for the duration of the Chap. 13. (He also gave us a little booklet with every possible question answered.)
He talked about the fact that we could not incur any debt or sell any assets without the court's approval, but he indicated that the court would understand the need for reliable transportation and that during the 3 to 5 years of our plans many of us would need to replace vehicles. We should contact our attorney who would file the necessary paperwork to get approvals.
After that he started calling cases individually. He was pretty easy going-- several people didn't have their payment with them and he told them to pay next week (I obsessed and had the money together weeks ago!)
Then it was our turn....he listed out the secured and priority debts...said "____Bank" for Toyota Tundra the great big sum of $757...well Mr. Lawyer Name we'll pay that one off right away....Oh I see they've cross collateralized that with a $3800 unsecured debt....Ok, we'll take care of that too." Then he talked about our mortgage being paid outside the plan, and all is OK with that.
So I'm thinking we're about to skate when the trustee said, "Which one of you recently sold an airplane?" I answered affirmatively. He said, "Did you sell it to a relative or friend?" "No, I sold it on Ebay" Then he cracked up laughing, said he wished he had seen that auction, and did we get a good price. DH said we could have done better if we had more time. He didn't even ask how we spent the money!
So we're approved and I plan to get a good night's sleep tonight!
