    Just Be Prepared!!

    Our meeting was a breeze! Yea! The couple of people before us had a little bit of a problem and had to provide more info to Trustee because they didn't come prepared and also acted like they didn't know what was even in their paperwork. We had all the stuff with us the Trustee asked for and we had answers to her questions and it only took about 5 minutes. Yea, 60 day club here we go!!

    just curious, what kind of info did they want? what did you bring with you?- was it the same kind of stuff you give your lawyer?
    We're filing chapter 13 mid-late april.

      From what I've read, it varies greatly from district to district and from case to case. Most always it will include such information as recent bank statements, tax returns, and pay stubs (if there are any). It can also get into property deeds, credit card statements, and lots of other stuff you could have to dig deep into your files for. They really just want proof that you haven't done anything that could constitute fraud.

        I'm sure it varies greatly. In our 341, the same 4 or 5 lawyers handled all of the cases I watched, they were on first name basis with the Trustee and joked around. We brought no paper work with us (attorney told us not to). The only thing that the trustee asked for from most of the people was a copy of their tax return. Which our attorney already had. Several times he asked if our attorney had a copy something (like proof our retirement was in a qualified plan). But once our attorney said "yes", the trustee said ok and didn't ask to look at it.

        I assume since the trustee knew all of the lawyers well, he knew that they were prepared and had all of their ducks in a row. I suspect in a busy setting, where the trustee wasn't as familiar with the attorneys that he would demand more info.

        An interesting exchange occurred, when the Trustee asked one couple how that they had valued a rental property. They had indicated that it was underwater, but the outstanding loan was only for about 50K. The trustee said he was going to get a independent appraisal. My attorney who was not involved in the case, spoke up and said he owned a rental property on that same street and it definitely was not worth the 50K. The trustee said "thanks, you saved me some legwork" then said he was going to abandone the property.

        Obviously they had a good working relationship.

          I am in Eastern PA and my 341 is next week.
          we need to bring latest pay stubs, tax forms, (2008) since I have not filed 2009 yet, but probably will before our 341 since my refund is only $360 and last year it was $2000.
          bank statements, mortgage statement, 401K statement, that covers the date we filed.
          Drivers license and SS card. proof of property value (attorney has).

            my 341 is in the morning, ( 3/29) and we sent a bunch of stuff to the trustee over a week aog. Bank statements, 401K, tax returns and such. Our lawyer has not said to bring stuff with us, and the trustee didnt contact us again after he received out documents. I wil be bringing some reciepts for the cashiers checks i got to deplete our account. it is about 2K for lawyer fees, filing fees, and car payment and utitily payments. As well as the reciepts for the cash we spent when we withdrew 250 the weekend before we filed.

            i am really nervous, and dont suspect i will sleep much tonight. i am just eager to get this done with!

              Lots of luck to you! If I were you, I'd go ahead and carry copies of all those documents you sent to the trustee just to be safe!

                You'll be fine. I agree with coolmom04, carry the documents just in case. It never hurts to have something right at hand if they need it. I was actually asked about something minor, had it, gave it to the trustee in two seconds, and it was given right back. So sometimes it could happen that they need something. It would be rare, I am sure, but I would rather have it with me than have my 341 continued.
