        One mistake after another. The Pro Se filer had totally screwed it up. Trustee told the filer "I can't tell you what to do, but you need to make sure that I get this form, that form, this schedule, these documents, etc.

        It's not that the trustee was not nice, the Pro Se filer was acting as its own attorney and was treated as such.

          YIKES, that's what I'm afraid of! I filed Pro Se today, and my 341 is scheduled for 4/1/2010. I was careful to not leave any property out of Schedule B, but my cash on hand & checking/savings balances were from what I had today ($114.24 in cash & $126.89 in the bank accounts). Those amounts will be totally different come my 341 meeting. I hope the trustee sees that I live paycheck to paycheck on a secretary's salary, and that I'm sole provider for my daughter. She can't be asking for my small amount of cash, can she?

            I've got one -- don't go in there attempting to keep a late model Mercedes. No matter how much you explain it retails for less than the average minivan/suv they never let the "Benz" brand go. I must have heard him say "The Benz" like 20 times

              I have some questions. Here are some of the possible questions asked at the 341:

              7. Have you made any large payments, over $600, to anyone in the past year?

              8. ... At the time of the filing of your petition, were you entitled to a tax refund from the federal or state government ? If yes: Inquire as to amounts.

              11. Do you own an automobile?
              If yes: What is the year, make, and value? Do you owe any money on it? Is it insured?




              If the person filing Ch.7 has made monthly payments of over $1100 in rent over the past year, is that going to affect the bankruptcy at all? If not, then what are they looking for as a red flag? Paying relatives? What if you owed debt to someone?

              Can they take away you tax refund?

              Can they take away an old Toyota with a value less than $2000?

                7. Rent is part of your living expenses, and won't affect your BK. If you are paying back a debt to someone, you need to make sure that you mention it, and report it on the proper schedule.
                8. I believe that they can seize some of your refund, the sum that's not exempted. I know very little about it, just from what I've seen here.
                11. If that's your mode of transportation, they won't seize it.

                  Hey Frogger, I remembered you had your 341 but missed this thread. Just wanted to say congrats on getting through another hurdle!
