Want to make sure that your 341 goes well? Here's what I learned today that will make you have a bad day.
1. Fraudulent transfer. Really want to see a trustee get pissed and show out? Then do a fraudulent transfer! That was the most interesting thing that I saw today. Would have made for good daytime tv drama.
2. File Pro-Se and don't fill out your forms. Don't list all of your assets, don't show that you own anything, and have a jolly good time answering when the trustee asks whose clothes you're wearing (because you didn't list owning any).
3. Show up without proper id. Drivers license that doesn't match, no social security card or documentation, or anything else.
4. Sell a vehicle after filing and before your 341. That was good for a really good a$$ chewing.
5. Continue to keep using your credit cards. The question was asked why did you keep using your cards and where are they now? The answer was "in the car outside" by one, another answered "in the kitchen drawer at home". These fine specimens were instructed to have them destroyed by 5:00 pm today and were told that they can not have a credit card.
6. Use a lawyer that does not do many bk filings. Have them leave off schedules, not fill out the paperwork completely, and generally make a complete and total idiot of themself. Now that was funny, doesn't matter which side you were on.
Trustee was nice, trustee was firm, and for those that were prepared, it was as easy as a walk thru the park on Sunday afternoon. Trustee was very nice to the filers (with the exception of the one that tried to file Pro-Se), but took out the wrath and fury on the attorneys that had not done their job well.
As for us? 4000+ pages of documentation, and a 6 minute 341 meeting. No problems, everything smooth, and a big thank you from the trustee for having great documentation. Trustee stated that our case was the best and most well documented case that trustee had ever seen.
Having to buy back a few assets, but no big deal.......... The bleeding has stopped and I'm not continuing to lose money every month.
