    341 was not so scary until...

    Attended 341 today. As we were walking into the room,a lady who did not speak English was up. Her attorney did not speak Spanish. There was a phone interpreter translating and the lady's husband was sitting in the audience. The trustee questioned her about her vehicles and who she makes payments to. While the trustee is questioning, her husband is telling her not to tell the trustee about the Dodge (my hubby speaks Spanish and understood what was said). The trustee asked if she understood what she signed and if it was explained to her in Spanish and the woman replied no. Trustee did not conclude the meeting. Their meeting lasted about 25 minutes.

    Our 341 went pretty smooth. The trustee asked the normal questions and asked if my vehicle was a lease and I said it was a loan. She told our attorney that would have to be fixed. She asked how much both my husband and I made and if we pay any spousal/child support. She then noticed an error in our paper work, told the attorney to amend it, and that our payments would be lower. WHAT???? A lower payment? My husband and I walked out with cool aid smiles. Thank God! None of our creditors showed up.

    Question about confirmation. Our attorney stated we would not have to attend confirmation. Does anyone have any knowledge about what goes on at confirmation? Any thoughts?

    I realize this post is a few weeks old - but no replies and here is what our attorney said about the confirmation hearing (copied & pasted from an email):

    The parties rarely have to testify or participate in the Confirmation
    Hearings...most are handled by agreement with the Trustee in pre-hearing
    discussions. Then an anouncement is made that the Trustee recommends that
    the case be confirmed, reset or otherwise disposed of. And then you leave.

    However, in the cases that do have remain matters to be heard by the judge,
    you need to have both parties present even if they do not testify.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      My confirmation hearing is set for 3-25-10 and I do not have to attend unless as my attorney stated I wanted too.. No thanks, I have had enough of this already
