    I need to breath, deep and slow....

    My 341 is in 6 days...that is if it is not postponed due to bad weather, in the middle of a ice storm.

    My attorneys para got onto me the other day. I called with a question, then she told me not to send the TT anything he asks for. I told her, he sent me a letter with information he said I had to send him, I complied, it is the same information you have, I also told you I was sending the information and what I was sending and you never said not to.

    Minor bump in the road.

    Anyway I am getting nervous...6 days...

    It seems odd that your attorney's office personnel would say NOT to send things to the trustee, after said trustee specifically requested them. I'm with you; if I got a message from the trustee asking for something, I would do my best to comply.

        Good luck! Mine was a week ago, and I have just felt better since the minute it was over.
        Mabye Atty. thought it wouldn't get there in time, and to bring it in person?? Thats the only thing I could think of them saying not to send it.

          It's customary when you are represented by a bk lawyer that your lawyer passes everything to your trustee. That way he/she can carefully look over whatever is sent which can keep you out of trouble. This is why the paralegal was unhappy you sent the papers directly to your trustee yourself - you bypassed that safety check.

          Your lawyer gets the same notifications you get from your trustee, so they were aware of the request from your trustee as well. If you get a request like this again, first contact your lawyer and ask who is going to supply what's requested and when. That way you won't innocently trip yourself up sending your trustee something your lawyer hasn't seen first (even though from what you said, the forms you sent your lawyer had already seen).

          Also that way your trustee will get what they ask for either from your lawyer or from you in a timely fashion and your lawyer is kept in the loop. Your lawyer's job is to keep your best interests in mind and protect you in the legal world where we non-lawyers have little to no understanding of the finer points of local bk case law and customs.

          Never forget that your trustee represents your creditors, not you. Always keep your lawyer in the loop, especially when your trustee is involved. Let your lawyer do his/her job representing you - that's what you paid that retainer for.

            Ya, its good. Like I said what he was sent the lawyer has as well. His para knew what I was sending as I told her what I was doing, and she never said not to.
