    Motion for 2004 Exam

    Brother's former partner completed his Chapter 7 - 341 on 12/18/2009.

    Main reason filing was due to business debtors filing suit. Business had been closed since 10/2008 due to the recession.

    Only creditor appearing at the 341 was the customers attorney for a 90K breach of contract judgment.

    Although the creditor's attorney asked several questions, the Trustee filed a report of no assets and the general paperwork recommending discharge.

    Both my brother and his former partner have reposessions, foreclosures and very little credit card debt aside from the 90K judgment. So BK made sense.

    On January 5th, the creditor's attorney files a Motion for 2004 exam based upon a signed, but undated contract which is attached to his motion.

    I'm wondering if others may have had a breach of contract based 2004 exam and if so.......What was the outcome?

    I'm thinking it's monetary, so it should be a non issue...Right?
