    341 meeting- Spouse can attend

    Our 341 meeting is schedule for 1/22/10, Spouse is disabled in chronic pain with multible issues. Can he be excused? How? thanks

    Have you filed jointly? If at all possible, you both need to attend. Now if he can't, have a Durable Family Power of Attorney in hand when you appear. Member Cali's husband was overseas in Iraq when their 341 was scheduled, and she had a similar document with her.

    If you have an attorney, he/she should be handling this. If you are filing pro se, call the clerk of the BK court in your distraict and ask about it. You cann also call your trustee.

    When you get the mail notice of your 341, somewhere on it will be--in mice sized type--instructions of what to do if you or someone in your party is a 'special needs' person.

      thanks for the input, Have Lawyer, told me to get Doctor statement an hope the trustee will allow him to do it over the phone, I was wondering if anyone else has the same problems. Hearing will be about an hours drive away.. I wonder if I can take him by ambulance and claim as an expense! I noticed you live in Florida! I'm from there but been gone for about 20 years now.
