Had my 341 last Friday . Walked into the room that my paperwork said and there was a waiting room there. So i waited for my lawyer as instructed . He walked in and asked if there was anyone there for XYZ law firm. There were 2 other people there that he was representing as well..He took us into a conference room and asked if any of us had any questions..etc..then went into the room and there were was a room full of chairs with the trustee sitting at a desk with 4 chairs in front of it. He told us to have a seat and wait for our names to be called. My meeting was scheduled for 10am and i waited until 12:30pm to be called So i sat through 2 1/2 hours of others peoples meeting which was a great experience and im glad i did so i heard all of the questions that were being asked to other people.
When someone would go up the trustee would ask the person to raise their right hand and swear to tell the truth etc.. ( and this is all being recorded by tape recorder.)
questions were like this.
Trustee asks for ID and social security card. You MUST have the originals !!
-Please state your name and address
-are you represented by an attorney? yes then lawyer introduces himself.
- have read this xyz form and this xyz form
- have you listed all your debts?
- is everything correct?
-did you sign this?
-is this correct? etc.
-Are you working?
-Do you own or rent?
- Please state the address of where you own or rent?
-IF you rent is a family member the landlord?
-If you own do you have any rental income from the property and if so how much?
- Do you receive alimony, child support etc?
-Are you working?
-How much money do you make?
-Do you have a car?
- When did you create most of your debt?
-When was the last time you used your credit card?
-Have you paid back any credit card more than $600 in the last 6 months?
- What is the purchase price of your house?
- How much money did you put down?
-At the time of purchase what were the other similiar houses selling for?
Thats is pretty much it. Then the trustee says....something about fraud? i said ..WHAT? ...i had transfered interest in property in 2005 to a family member and i need to send the trustee some documents including a HUD statement....but my lawyer assured me everything was okay...and that with any property transfers going back to 2003 there is a assumption of fraud...and not to worry about it because everything is fine...i was a little nervous about this...but im taking his advice and im going to try not to lose any sleep...
anyways...60 days left..hope everything goes smooth...xxx crossing my fingers
