    Is student housing debt NOT related to student loans dischargeable?

    I rented an apartment through my university but paid the rent monthly directly to the housing and did not take out any loans. The rent was not included in my tuition or paid with a student loan. I now owe student housing for unpaid rent. Is this dischargeable under BK 7 or is it considered a "student loan" since it is related to education? I am going to pay this debt regardless because I am going to re-enroll at the university but I am wondering how this debt would be treated under BK law. Thank you.

    Probably dischargeable. Just like unpaid tuition is dischargeable. To be a student loan, it must meet the definition of a "qualified student loan". Thus, if you owe rent for student housing, or unpaid tuition, those debts do not magically become student loans (despite the position of the university). You may have some problem re-enrolling in the school if you discharge this debt and good luck ever getting your transcript. Although it is a violation of the discharge order, it is pretty much standard policy for schools to withhold transcripts if you owe any sort of debt to it.
