My husband has student loans in repayment that we can't afford to pay and we have used up the deferment periods. How long can we skip the payments before the private student loans attach my husband's pay? And is it limited to 15%? Does the attachment stop under a chapter 13 BK?

The length of time between default and garnishment will depend on the lender. I don't think there is rule of thumb for that other than it will be months and not days. Any attachment will stop while the BK automatic stay is in effect.So the poor debtor, seeing naught around him
Yet feels the narrow limits that impound him
Grieves at his debt and studies to evade it
And finds at last he might as well have paid it. -
