    What is the current court opinion on dischargeability of college tuition owed directly to the school (not loans)? DH and I both have outstanding balances due to a well-known private, primarily online university and I *believe*, although I'd have to go dig out the enrollment paperwork, that there was no promissory note involved.

    Tuition owed directly to the school or to a collection agency has generally been dischargeable but often you will not be able to get your transcripts if you bk on tuition.

      well hard case but I think 'backtoschool' is quite right with his statement that you will not get your transcripts if you bk on tuition.

        Perhaps I'm missing something, but if the discharge is granted, what legal recourse would the school have for continuing to withhold the transcripts?

          They don't have legal recourse to hold the transcripts even you don't pay or BK. Check your state procedure.

            I have the same situation as the OP and my tuition was at a state school with no promissory note except to an outside lender and they told me that if I file BK and submit the discharge paperwork to them, then the transcripts would be released. Actually, it was a supervisor in the billings office so I assume she knew what she was talking about.
