    Student loan debt when filing bk

    I have $20,000 in federal loans and $20,000 in I guess what is a private student loan through AES. I know that these cannot be discharged but do they use these to show your total amount of debt if you have not started repaying yet? I'm just wondering where they fit in during bk.

    They show as unsecured non priority debt on the petition, but they show in their own category as student loans.

      Also, according to my attorney they are not counted in triggering the trustee to start scrutinizing more than 100,000 in debt. If your dischargable and student loan debt add up to 100,000, they don't take a harder look the way they do if it is all dischargable.My student loans were listed in my matrix along with the dischargable debt.

        I agree. Since student loans are not dischargeable, they are not counted in the 100k threshold to trigger the US Trustee to possibly look at your case.
