    New Student Loans

    I am planning on going to school in the next two years. My student loans were in default prior to my filing chapter 13 (under old law). OUr case is now closed - but we are still awaiting discharge.

    How difficult will it be for me to obtain new student loans given my previous default status?

    Generally, the BK does not effect your eligibility for student loans since your credit worthiness is not a factor. Now, if you are still in default on existing student loans, that could be a problem.

      If they are defaulted federal loans you will not be eligible for new federal loans with those old ones still in defaulted status. I just had a lenghty discussion with the financial aid office at my school and was told the above.

        At this point, I don't know who owns my student loans. How can I find out? My account has been passed at least 2x since Bankruptcy started.

        I have no problem getting back on a payment plan with whoever has it, so long as the default status is 'removed', so to speak. After all, it is still my obligation to repay those...

          May understanding is people are using these crap of selling a loan to get out of it. you can ask to see the orginal signed loan papers normaly they can not sure them and must take them off. Now with that said student loans may be differnt i know if you default you can not get another till the first is back in good standing bk or not
