    Creditor claim after Ch 7 discharge

    Got a letter this week from an unknown creditor, who must have bought some debts from the old NextCard VISA (now defunct.) That debt had been included in my bankruptcy, now discharged.

    Here's what I intend to fax to them:

    To: Platinum Recovery Solutions, Inc.

    Re: Nextcard acct # xxxxxxxxxxxxxxxxxx


    Please provide the address of the original creditor.


    This is to notify you that I am disputing the validity of your claim.


    That debt was included in bankruptcy, discharged 01/18/2006, case # xx-xxxxx


    United States Bankruptcy Court, Northern California, San Jose Division

    Do I need to write anything else, to dispute the debt and request validation?

    Call me paranoid here, but,..........

    If you fax the letter, take it to a copy shop to fax for you. Don't let that company have your personal or business fax number. Otherwise, I'd mail the letter via Certified mail. They already have your address. Leave it at that.

    Also, I wouldn't give them any info at all. Just dispute the validity of their claim by saying you've never had credit with them before. Make them tell you more about the debt instead of you telling them. Don't give them ammo to use against you in some way or another.

    They already know the debt has been included in BK. They're a Zombie Debt Collector who bought the debt for pennies on the dollar. Now they're trying to make money off of you.

      I would just call them. Inform them the debt is uncollectable as it was included in chapter 7, and give them the case #.
