    Some accounts stlll open on credit report, post ch7

    Can you help me understand my post BK credit report?

    I got my free credit report from experian, and it shows that my second mortgage is discharged by ch 7/ and never late, yet still is reporting balances and payments. By contrast, all the credit cards that were discharged show no more reporting.

    Under accounts in good standing, it still shows my first mortgage, which should have been discharged. It does not say it is discharged. It shows the account as open/never late, and reports the payments. Same thing with my car loan.

    Also, less of an issue, there is one credit card that lists open/never late with 0 balance and still reporting. A card that I am pretty sure is defunct and perhaps long forgotten when I filed.

    As for first mortgage and car loan: is this a courtesy they are extending me? Is it to my advantage to have them report this way? Or is it meaningless for my credit score? Or worse, should I get this corrected because it means my debt is not showing up as discharged? Or, is this an advantage to me, plus to them, since they can ding me if I stop paying (I am in a pay and stay situation). Can they ding me on discharged debt that hasn't shown up as discharged on the credit report?

    Some of the same questions go for the second mortgage that shows as discharged, never late, and still reporting balances and payments (this is a HELOC from BofA soon to balloon and then certainly going to have missing payments).

    My BK itself does show up on the report, of course.

    The other open card I don't think is helping or hurting me.

    The positive reporting on your mortgage and car is a good thing. The fact that the creditors are not reporting the debt as discharged in BK gives them no right to pursue you for the discharged debt.

    The only thing I can see as a possible issue is trying to get a mortgage in the future with your credit report showing that you are still liable on a mortgage. If you later apply for a mortgage, you can get any needed corrections made at that time. Other than that, I'd let them continue to report timely payments.

      I know they cant pursue me for the money, but can they ding me on the credit report for failing to pay? If I decide to stop paying, will I need to get them to correct the report first, and will they do it?

      So, you think the open/never late mortgage and car survived the rapture and that this is positive reporting and that it is counting towards my credit score, even though the debts are discharged?

      The weirdest one is the 2nd mortgage, since it reports as discharged, yet the payments keep getting reported. What's up with that?

        I misunderstood your question. They cannot legally report any late payments on a discharged debt, but sometimes it happens. Keep an eye on your report and dispute any negative reporting. I wouldn't dispute it now. It is possible they will leave the positive payment information up to the date you default and simply stop reporting or changing the status to "included in bankruptcy".

        If they are still reporting that way, they are having a positive effect on your credit.

        That is odd. Since it reports as discharged, I'm not sure whether the reporting of timely payments helps. But it certainly doesn't hurt.
