Hi all! We originally filed CH 13 to include 1st mortgage arrears and try to strip 2nd mtg. Instead of stripping the 2nd we came to an agreement through an adversary preceeding that wiped out all late fees and reduced the interest rate significantly. We worked out a loan mod with the 1st mortgage that included the arrears and lowered the rate. So we were then able to convert our 13 to a 7.
We are now discharged from our CH 7 (yay!), and I am in the process of cleaning up the credit reports. Luckily, Cap One disappeared altogether and the other cc's are reporting correctly. However, both mortgages are reporting incorrectly and I am not sure of the best and fastest way to correct them.
Both mortgage companies list as Closed, $0 balance and Debt included in or discharged through Bankruptcy Chapter 7, 11, or 12
The first mtg shows no data for EQ and TU but shows as 120 days late through 9/10, then no date until August where it shows KD.
The second mtg shows us as 60 days late in 10/09 when we first filed the 13 and goes up to August 2011 as 120 days late.
I am assuming these have not been updated? They should not be listed as closed or included in BK if they are paid?
