    I want to sue Experian

    I just had it with Experian, I disputed all the accounts with them that they are not reported correctly, after a month they are saying that Providian will stay as being charged off, they will not add to included in Bankruptcy.

    And after the dispute they have added HSBC NV to my account, when I disputed that this is not my account they are saying that HSBC NV told them this is my account. I never had any account with HSBC NV and they refuse to give me the full account number, HSBC can't find any account with my SS # and they are asking me for the account number. This is just great.

    Did anybody ever here sue Experian?

      Try this, it is working for me. Go to Trans Union, and sign up for True Credit ther service you want is "3-Bureau Credit Monitoring". It's 14.95 a month, but once you see that items are reflected correctly you can cancel the service. The problem is everything is not reported realtime. Something could have changed on your report, and by just viewing it you will not see the changes. I learned this the hard way I had 5 disputes going at once by just by viewing the single report the completed disputes didn't show any change.

      Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

        I've never heard of anyone suing a credit reporting agency. Do you have your bankruptcy papers that clearly show the Providian account with the same account numbers as having been included in the bankruptcy? When you order a report from the agency, you get a phone number you can call. Do that and talk to someone. But be calm about it.

        If there's an account on your credit report you never opened, you could be a victim of identity theft. As long as you can prove this account isn't one that was yours under a previous company or something like that, file a police report and get a fraud alert on your credit reports.

        Suing isn't easy. You need documents and proof and money and time. Try to fix things through normal channels first.

          They are refusing to give me the last 4 digit of the account number, and HSBC NV is requesting the whole account number to find out whose account is being reported to my report. I have disputed it with Experian and they are telling me that HSBC NV told them that the report is correct. When I call HSBC NV they cannot find any account under my name or SS#. It's like I'm in a endless loop. I don't see any other way but to take them to small court, small court is not expensive.

            Try seeing if HSBC NV will send you a letter stating that they cannot find anything in your name and ss#. Then try forwarding that along with a letter (certified mail, return receipt) to Experian stating that they have 30 days to correct the info, or you intend on pursuing legal action against them for not reporting correctly even though HSBC NV has stated that they have nothing in your name. See if they do anything then.

              Have you done this by mail or on the phone? If you have been on the phone, it's time to use the USPS. Have you asked for a Procedures Request? They must, by law, give you the exact procedures used to investigate your dispute. Not a form letter, the exact procedures for YOUR dispute. If they don't or can't they must delete the incorrect info.

                Yes I have disputed via mail also talked to them about it, and they told me that they checked it with the creditor electronically. I have mailed Providian and HSBC letters requesting that it be removed, I'll wait another 25 day and if I don't get a written response than I file a complaint with the small court. It costs $125 to file a complaint and the defendant will have 30 days to response.

                  I sued and won

                  I have one more to go but I sued all 10 of my creditors and all 3 credit reporting agencies and won most of the cases and 4 others were settled with the agreement to delete the accounts from all three credit agencies. I technically have over $30,000 worth of judgments that I can collect but I am only interested in getting the accounts deleted.

                  It only works if the creditors are genuinely reporting false information on one of the records that includes calling an account a charge off when it is really a bankruptcy.

                  How I won is I filed a claim in small claims and sited the FCRA where they are required to appropriately verify an item within 30 days or delete it. If the creditor reports an item as "verified" when it's incorrect they HAVE to delete the account when you send proof it's false. No NEGOTIATING if the creditor did NOT verify the information correctly don't settle for them "correcting" it. It's too late, they had their chance and keep trying to falsely report the information. Now they have to delete it.

                  I only won a money judgment, they didn't allow specific performance to remove the items because they didn't have juristiction but I was told that if they don't delete it now, I can sue them again. I have also been told by the court that they can enforce the judgment against the bank creditors with a writ of execution. Don't let them bully you! You may have filed bankruptcy but you don't deserve to get double or tripple black marks on your credit report! Good-luck everyone!

                    Good information startingover06. Can I use this same approach to my creditors who have charged off my accounts, but used the wrong chapter. I am in a chapter 13, though alot of the creditors are showing charge off, chapter 7, 11, or 12.

                            I truly don't know who they employ at the CRA's but we have had nothing but issues over the past two years getting items reported correctly, especially with Experian and Equifax. We cleaned up our reports totally in 2007. We obtained our free reports this year and lo and behold, several accounts started showing new "Date Major Delinquency Was First Reported" with dates ranging from 2005 to summer of 2007. Our BK was discharged in 8/06. Obviously incorrect information. Well, we disputed the information and got back that the accounts were being reported correctly, as being included in and discharged in bankruptcy, but the dates remained. We redisputed. Experian returns our dispute information changed but then lists the accounts we disputed as being discharged in Chapter 7, not Chapter 13 as was correctly listed the first time.

                            Now folks, this is obviously a key in error and I truly believe no one actually takes a few more seconds to observe what is being correctly listed in your account information in the CRAs. Tell me how information can be changed from a 13 to a 7 in just several reports you disputed while others remain correct and there is a Chaper 13 Court filing listed on the same report, nothing as to Chapter 7. I feel the system is a quota system and they have deadlines to meet and just put in any code or number to try to meet your dispute and just send it on out. We have provided detailed information as to each dispute in letter form and we feel it is just totally ignored. They say the information has been verified but when we look on the report, the last verified date was two years ago.

                            Unbelievable....
