Should Collection Accounts still be listed on report?

    Hello all,

I was discharged 5/16/2011 and am just beginning the report clean up process. I've been reading the boards but remain unsure as to whether this is a legitimate listing.

It is listed as a Collection Account:

    Creditor Name: Asset Accept
    Acct. #: xxxxx
    Original Creditor: BofA
    Condition: Derogatory
    Original Balance: xxxxx
    Balance: $0
    Date Opened: 10/29/2009
    Date Reported: 04/17/2011
Remarks: Chapter 7; dispute of account information

Should this item be removed now that the debt has been discharged? And is there any significance to the reporting date since it was reported after my 341 meeting?

    Any help would be appreciated...

Unfortunately, they can and most of the time will be staying on your report until they fall off due to age. Since they are reporting IIB and $0 Balance, they are playing by the rules.
    Filed CH7 9/24/2010, 341 on 10/28/2010, Disch.&Closed: 1/6/2011. FICO EX: 9/2: 672.
    FICO EQ: pre-filing: 573, After BK Public Record: 568, 10/3: 673.
    FICO TU: pre-filing: 589, After BK Public Record: 563, 9/2: 706.

It says it was opened in October 2009...was this when Asset Accept bought the account, or is this when the account was originally opened with BoA? If Oct 2009 is when Asset Accept bought it, then there's really nothing you can do, the information is accurate. However, if the Oct 2009 date is when the account was opened with BoA, and the April 2011 date is when Asset bought it, then that's a no-no. You should have no new collection activity from pre-bankruptcy accounts as of the date of filing.
Standard disclaimer: I'm not a lawyer. I am an idiot. Do not take my advice. I am not responsible for what happens if you blindly follow an idiot's advice. Blah blah and more legal stuff.

I'm guessing that the Oct '09 date is when Asset Accept bought it as it is an older account. Sounds like it is being reported correctly then. Just wanted to be sure. Thanks for the clarification!

I have two "accounts" with them on file as well. In my case, they reported POST filing BUT obviously obtained the account PRE filing, so I was out of luck with them as well.
