    What can each creditor legally incude in the, "Comments" sections of their reporting

    I pulled my three credit reports and all of the creditor comment entries were noted as included in my BK for Equifax and TransUnion and are reporting, "BANKRUPTCY CHAPTER 7 - INCLUDED IN BANKRUPTCY" with no additional comments regarding delinquency or past due dates/statements. However, Experian included a couple comments regarding two creditors 60 day late payments and the months they occurred before listing, "Included in bK". The payment history detail for each of the accounts are all cleared out with no reference of late payments. I believe the information is correct but my question is if anyone knows if this can be disputed and the "Comments" removed to match the Equifax and TransUnion reporting to only state that that they were "Included in the BK"?

    Any information from the group would be appreciated. Thanks!

    I don't dispute correct information. They are allowed to comment that you were late, unless it is past the SOL.

        Usually SOL means statute of limitations ... but in regards to what they put on there they cannot mark you as late, deliquent or "charged off" AFTER your bankruptcy filing date. If you have any mention of a late or charge off recorded after your file date anywhere... whether its in the comments or last date of delinquency, dispute it. If you were late before you filed for bk, then that is permissable.

        But, you can't really control the wording that they use on stating that you filed for bankruptcy. Some of my creditors have it listed differently on different reports for the same account. It will typically say something like you mentioned or have your filing date in it or a variety on the theme.

          Thanks Amy26... The comments posted were only on one credit reporting agencies report AND the late dates were after my filing date. So I will dispute them for sure then. That's what I was thinking but I wasn't sure.

            Good luck! I am doing the same thing at the moment. I have heard that a lot of people fight with the charge off & late dates for a while. Some have disputed with the bureau only to have it verified and then dispute with the original creditor and still have it verified... so, if they do that then you actually have better grounds to threaten to sue them if they don't fix it. I have also heard of some people getting the account removed completely after such violations.
