    Filing Date vs Discharge Date

    I have experian report that shows the same issue on multiple tradelines.

    The petition was filed 7/09. Discharged 11/09.

    Under Account History

    Charge Off as of Oct 2009
    60 days past due as of Sep 2009
    30 days past due as of Aug 2009
    Filed Bankruptcy Nov 2009

    Does account history have any real effect? Is the reporting inaccurate as of date of filing or date of discharge? Is there a difference between reporting Chapter 7 petition and Chapter 7 Discharge?

    I would say thats an inaccuracy if they are reporting you filed Nov 2009, instead of July 2009. Your credit report should show your filing date, and discharge date.

      Thanks for the info.

      I'm just trying to determine if there is a technical violation and if so is it worth disputing. The status is IIB. The balance is zero. However, does the fact that the account history states a charge off or past due after the filing of the bankruptcy but before the discharge have any bearing? It seems unfair/inaccurate to put on the account history any past dues or charge off's after the petition was filed - but since the debt isn't actually gone until the discharge, wasn't sure if this was allowed.

        EX seems to use discharge date while EQ and TU uses filing date. For me all my tradeline that were included in BK will show discharge date for EX and filing date for EQ and TU. I tried to dispute but it came back as accurate. I think the filing date is more determinative, but I'd probably have to take a creditor or EX to court to prove it.

          There's no doubt if charged off was listed on the status line, and it occured after the filing date and before the discharge, that would be a violation. So I don't know why it would be allowed on the Account History comments. Every account is going to be at least 60-90 days late after the petition before the discharge. I sent the FCRA letter out today. If it comes back accurate I'll throw it into court and see what happens.
