    Is this trick too god to be true? - Bankruptcy removal off CR after only 2 years.

    I saw this online:

    Under the Fair Credit Reporting Act negative information can be included in your credit reports for seven years.However, there are exceptions to this rule. Bankruptcy is one of those exceptions. Bankruptcy information may be reported for 10 years. Sorry.Once the ten years are up, there's nothing you should need to do. If for some reason a credit reporting agency keeps reporting the outdated information, click here for more information about fixing errors in your credit report.On the other hand:Actually there is a legal way to get it removed approximately two years after filing! I did this and it works and I will be willing to prove it to any doubters!. All you have to do is file a dispute with the credit bureaus. In my case I simply said it should have been listed as Chap 13 and not Chap 7. This is the trick though, so please read on carefully. YOU MUST WAIT A MINIMUM OF TWO YEARS AND A FEW EXTRA MONTHS BEFORE DISPUTING WITH THE CREDIT BUREAUS. Why is this you ask, well the answer lies within the bankruptcy courts. All cases are active for two years after which time they go onto microfiche. When they get a dispute letter from the credit bureaus and the case is on microfiche then they don't bother to respond. The credit bureaus then must legally delete the info from your reports. The trick is to follow up with the bureaus also and make sure they delete it. More information:If you filed Chapter 13, it should have fallen off already since those come off your report in 7 years. Many people in that situation have the credit reporting agencies do an "investigation" of their report to remove it.If you filed Chapter 7, then you have two years to wait since those come off your report in 10 years (see Section 605(1) of the Fair Credit Reporting Act).Please note that nothing in this posting or in any other posting constitutes legal advice; this is simply my understanding of the facts, which I do not warrant, and I am not suggesting any course of action or inaction to any person.According to Golden Financial Services, after two years a bankruptcy can be removed off a credit report.

    i heard about this before and actually have challenged the agencies myself and they have ended removing items after the 30 day limit...i'm not really certain you can or will get the bk removed that easy...but it would not be surprising to hear one or two slip by them.

      ...but won't all of your accounts still read, "Included in Bankruptcy", which seems like it would throw up a red flag if you don't have a BK listed in the public records?

        I heard that in my state, the bk stays on the state's records for 20 years. I wonder if the credit bureaus ask for your discharge document from the court when you dispute.

          20 years...no...yikes..not on your credit reports...they can only list it for 10 years...however, i have heard that a bank can tell you "no" even after the 10 years has past...amex is known for that one.

            That's right tobee. Even though on your report it's "only" for 10 years but my state is 'generous' enough to maintain another decade on their record book to humiliate those who filed 20 years ago.

              how nice they are...oh my!! that is just terrible! 20 years...now how does that effect you "credit" wise...i mean where the state document it?

                I just say screw them. I'm not sure how it'll affect me creditwise but unless I apply for a state government job, I could care less. What's done is done.

                        There is no legal way to get a BK removed off your credit report and places get rich everyday stating it can be done and having folks send in hundreds of dollars for something that is just temporary. Anytime you file a dispute with a CRA the account(s) in question is/are temporarily removed while they are verified and that is done with the creditor. Once the information is verified, guess what will reappear on one's credit report. The CRA's are all aware of people trying to dispute their BK information as incorrect and eventually most people get responses that all information has been verified and if one continues to dispute it is just eliminated by the CRA as being "frivilous" and you will be requested to dispute directly with the creditor which will get you nowhere. The CRA has nothing to do with the public information records and you will be advised to contact the court directly as to any public information listed about your BK in the credit reports as the court is the only one who can change that information.

                          Thanks tobee. Today the first snow of the season just came and it's already 8 inches. This is not a typo and another round, at least 4 inches more, comes in tonight and tomorrow. Darn it.

                            I will try this just for kicks. I did dispute some items that were true and got them deleted after the bk. Some stayed but at least some got deleted. You do not have to do this the old fashion way as some suggest. Online works just as well.
