    Experian BK reporting

    This is a statement I just received from Experian on some accounts that I had disputed that were showing 30-90 day lates and charge offs, all occuring after I filed BK.

    "Experian seeks to report a consumer's credit history accurately. Delinquencies that occur after the petition date but before the discharge date are part of a consumer's credit history as they occur at a time when the consumer has not yet been discharged from the debt. Experian does not report on delinquencies occurring after the debt has been discharged."

    What do you think about this?

    You should contact your creditors directly to have the information changed on your reports. Sounds like you may have been disputing some items for a while and they put up a wall. Work with those creditors directly to have the information listed correctly in your credit reports. We had to do that also and it takes a while to eventually get everything to report correctly, sometimes a few years.

      Actually this is the response on the first attempt to fix the reporting.

        Rick, I have 1 or 2 cards that showed 30 days late even though I filed with no late payments.
        I didn't care since my credit has bounced back rapidly but just last week I decided to pull 1 bureau every few months and dispute any possible errors. My transunion which was the first I pulled has none but the others definitely had 30 day lates.
        I'll be interested in your outcome.

          If that is your first response, go through the creditors directly. Remember if any payment was late prior to your filing date, or if there were chargeoffs prior to the filing date, they are going to show on your reports. I see you state you were not late but do you know for certain the last due dates for the payments you made were in the 30 days prior to filing. It also depends if Experian is allowed to do that. They may have changed their policies.

            Experian is not allowed to do that because you are in the automatic stay period. I would contact the creditors since you have already disputed with the CRA's and then if it is not correct send a 623 letter (check www.creditinfocenter.com for samples) and if that does not work, then sue Experian in small claims. Remember, Experian is also the one that no longer provides FICO consumer scores - they have elected to be consumer UNfriendly.

              I am quite sure that I was not late or charged off prior to filing. My previous late/charge off/collection was 3 years prior to filing. I understand that anything that happened prior to filing remains.

              I filed the end of May and a example of one account now reports:

              30 Day late June
              30 Day late July
              60 Day late July
              90 Day late July
              90 Day late July
              Charge Off August
              BK discharge September

              I had never been late on this account.
