Prior to the completion of our bk, my husband's/my checking account had a legal lien put on it by a creditor for $1000 which would expire in 5/2011. The Sheriff's office that administered the lien said that unless the creditor filed a release with them that any funds in the account can be claimed by the creditor after 5/2011. My attorney said that basically the creditor has a right to those funds and that there is no persuading them to release/return them.
Has anyone been through this and can share any info?
It is now post bk (almost a year), and the funds are still on hold in the bank. Is there any way of retrieving the money? The loan owed to the creditor has been included in my bk filing.
