    Post discharge Equifax question

    Hello all,

    I was discharged in July of 2009. Everything was fine until about two months ago. Started to receive robo calls from Suburban Credit corporation. Last week
    calls stopped. Today an alert from Equifax via Expendian service was posted:

    Potentially Negative Alert
    Reported on 2/5/2010 by Equifax
    Company: SUBURBAN CREDIT CORPORATIO
    Balance Date:
    Current Balance: $
    Status Date: 2/1/2009
    Payment Status: IN BANKRUPTCY (IN BANKRUPTCY)

    Any insite by anyone?

    if they where listed in your bk schedules.sounds like the creditor messed up.they definetly should not have been calling you.they where in violation for doing that.sounds like someone all of a sudden finaly woke up.

      This is a violation of the discharge injunction.
      You should first send a letter to the CA with a copy of your discharge demanding immediate removal from your CR. If they do not comply, sue them for damages. It is much more serious than an FDCPA violation. Bring it to the attn of your attorney - they will have to pay his fees because they clearly have violated and you will end up with some funds.
