    Credit Report - Public Record?

    Hi guys,
Sorry I searched the forums but was unable to find an answer to my specific question.

I have been discharged since 12/21/2009

I just logged on and got my annual free credit report from Experian and surprisingly everything looks good.

    Everything except this one.
    Public Records

Credit grantors may carefully review the items listed below when they check your credit history. Please note that the account information connected with some public records, such as bankruptcy, also may appear with your credit items listed later in this report.

    US BANK

    Identification Number:
    XXXXXXXXXXXXX

    Address Identification Number:
    XXXXXXXXXXXXX

    Status: Chapter 7 bankruptcy discharged.
Status Details: This item is scheduled to continue on record until Sep 2019.

    Date Filed:
    09/18/2009
    Date Resolved:
    12/21/2009
    Responsibility:
    Individual

    Claim Amount:
    NA
    Liability Amount:
    $0
First of all, is it okay that this one (and ONLY this one) is listed under public record? Why would only this one be listed under public record? Any guesses? (it was my bank account).

Second, Why if I filed for chapter 7 does it say that it will be on there until September 2019?

    I'm confused!

Should I be protesting either of these two things? The "public record" or the "2019"?

    Thanks everyone for your help!

What it means is that your bankruptcy filing is public record and can be found by anyone looking for it or during background/credit checks. So that means that this account, included in your bankruptcy filing, will be listed in your bankruptcy records when viewed. Your Chapter 7 bankruptcy filing will remain on your credit reports for 10 years from your filing date. That is why you see the date of 2019.

Actually, the TL may not be reading correctly, depending upon what the US BANK tradeline (TL) is for you: a mortgage, cc, or other unsecured debt. Flamingo is right about the BK filing remaining on your credit report for 10 yrs under the public records section.

Then each of the creditors that has been discharged in your BK should have a notation iib (included in bankruptcy) and a zero balance. If US Bank is one of your TL's then it would be in the derogatory TL section of your report along with each of the other discharged TL's.

If US Bank is a foreclosure prior to your filing, then it would remain on the public records section of your report. If the foreclosure was started after your BK it should not show on the public records section.

A few years ago I was taking a mortgage application and ran this persons credit. I forget the credit scores but they were well into the 700's. I quoted this person and hung up and prepared the paperwork for mailing.

As I reviewed the credit report more thoroughly I found a public record for a BK that was just over 7 years old. I called the borrower back to confirm and she did.

Everything negative had dropped off except for the BK and no one cared that she had a BK. I never mentioned it again and no one ever asked about it during the loan process.

7 years is much more important than 10 years!

I got the courage to pull my report today. Under Public Records, the only thing showing is the Bankruptcy information. (i.e. court, id #, date filed, status).

The mortgages I have all show under under the credit history section. Like below:

          Account Name: xx HOME MORTGAGE
          Account Number: XXXX
          Acct Type:
          Acct Status: Closed
          Monthly Payment:
          Date Open: x/x/20xx
          Balance: $0.00
          Terms: 360 Months
          High Balance:
          Limit:
          Past Due:
Payment Status: Debt included in or discharged through Bankruptcy Chapter 7, 11, or 1
