    Found out why my TU score was so low!!

    Last time I checked my TU credit report (a month or two ago) I didnt see any obvious reasons why my TU score was lagging 60-80 points behind my EX and EQ scores (acquired through myfico). Well today I decided to log into myfico and get an updated TU report....

    Some stupid (#@)@ing *@#()!)$*&&&$$$ Collections agency slapped a collections on my TU from something that was discharged in my bankruptcy in April 2009! They just added this October 2009, so its so obviously a blatant violation of the FCRA.

    Anyways, myfico has this letter generator for TU, so I printed up a letter, wrote my own as well, enclosed my 341 notice, my discharge, and my schedule F with the discharged account in question highlighted.

    Is this happening to anybody else? How long will I have to fight these "phantom" accounts?

    I had it happen with my last BK in 2001. There was one account that actually got passed to 3 more collection agencies after the debt was discharged.

        Not really. People can talk about the laws and the protection that it provides, but talk is cheap. Unless there are "multiple" complaints and massive violations, the gubmint really don't give a rats rear end about those complaints.

          Ok. There is an attorney in The Woodlands, TX that seems to specialize in stay violations. I am just vaguely guessing that is what the OP's issue falls under.

          I happened to run across his web site when I was looking for something else. Some people might find that worth googling.

            Well the letter was sent out yesterday... I put 2 stamps on it JUST TO BE SAFE...lol. It was kinda on the heavier side, maybe .9 ounces (anything over 1 ounce goes to $.61 postage).

            Updates to follow.....

              You should get action on that letter - the CA should delete immediately. I had a CA do the same thing and I made a phone call to the CA. The collector I spoke to was not helpful, but I specifically said I was going to sue for attempting to collect a debt after the discharge. He hung up. About an hour later I got a phone call from his supervisor not only deleting the account on all of my credit reports, but sending me a fax of the e-oscar communication to each of the CRA's. I can only assume the original call was recorded and the supervisor knew I was serious.

                The department that takes incoming calls and the department that does deletions are probably not one in the same. The guy you talked to at first was probably just a call center rep. They don't really have the ability to do much in the system, but if he "did the right thing" and escalated it to the right place, that is why you got such a quick response.

                  I'm waiting for my discharge, but have been checking my CRs to see if things are reporting correctly... overall perrty good at least all the errors are the same on the three reports! Looks like one of my bk'ed creditors citibank has sold or transferred an account today, so it looks like I will be using your methods in getting it removed, once I find out who they sold it too?
                  Also, my mortgage "Chase" is not showing as included in Bk and also should only be 60 days late when I filed and not the 120+ days as shown on my CRs. Should I wait until after I receive my discharged paperwork, or send a letter now?
                  November 2, 2009: Filed Chapter 7, December 10, 2009: 341 Done! January 11, 2010 Last Day for Objections! February 9, 2010 Discharged!!! February 12, 2010 Case Closed, MyFico on 11/09: 550, Now: 715!

                    Have you worked in a credit reporting agency before? Because you seem to know how the work is divided. They keep the people who take calls segregated from the people with "direct" database update ability. They watch the "direct" update people closely.

                          Sure, Bren... If I feel I can help, I will definitely try to do so. Not all CA's are created equally however, so it's a little tough to call sometimes. Plus, that was kind of a long time ago and I am sure things have changed.

                            Well I received the action letter from TU yesterday... they didnt remove the collections citing it was from before my bankruptcy discharge

                            Thats crappy... My Lawyer advised me not to pay any bills (this one particularly - a gym membership) because Im now bankrupt. So after the first month of the draft not going through, the gym called me and I informed them I was bankrupt... apparently they sent it right to collections. THAT is whats dragging my TU score down

                            Anyways, I will dispute it again in 6 months or so.. I will keep disputing it until they get sick of me and remove it.

                              Yeah that's crappy, but before your discharge... doesn't that make it a stay violation on the part of the CA? I think so. You might want to research this some more and write them a good threatening letter.
