    Question about Experian reporting

    Hi again everyone,

    From my last few posts, you can tell I am about to try and re-establish credit. It's been 10 months since our discharge. And a recent credit score drop due to not enough revolving credit, prompted this. Just applied for my first account from a BK friendly bank... DENIED!

    This got me to pull my Credit reports.

    Question on Experian... Most all accounts show the correct IIB, BUT, Several accounts show late payments from the date of filing to discharge date. (4 months) Is this reported correctly? (We had no late payments at all prior to filing)

    I want to get these late payments removed, as I thought "technically" we were no longer responsible. AND, they took away the abilioty to even pay them!

    Hi FloridaGuy! I am experiencing the exact same thing with Experian and it is NOT correct.

    First file your dispute in writing (not online as you want a papertrail) to the CRA and then if the CRA does not correct within 30 days file your dispute with the creditor. If the creditor still does not correct, file in court for sanctions .

    The creditor can NOT report any lates or any charge off notification after the file date.

      Im having the same problem with experian and some equifax too. They have the BK7 date correct so it would seem like an easy fix for creditors reporting outside of that date. But the CRA makes no changes and simply says consumer disputes, meets guidelines blah blah. I dont know if I want to contact the creditor because I have had great results with Trans Union and I dont want them to mess with that.

        Update

        Hi Guys & Gals,

        I actually called the Experian toll free number just to ask about the reporting. The agent on the other end was very helpful and friendly. She took her time, and didn't make me feel like I had to rush, or she had to hurry the request.

        She asked If I knew how disputes worked with them... I said basically... yes.

        I do not know if this is correct, but she stated even though the BK was filed in Oct. They can actually (Per Federal law) report the time between filing and until discharge as delinquent.

        She started an investigation, ask for my e-mail and told me they would let me know results as soon as resolved.

        I left for work. When I returned home... I had an e-mail and results!

        There were a total of 10 accounts effected originally. 2 accounts, were completely deleted, all the rest were updated.

        Only two (yes... 2 out of 10) still showed any late payments... and instead of 4 or 5 months worth... they only showed two months. (Nov & Dec. still right in between the filing and discharge date)

        Per their instructions, I can contact the lenders directly, to see if they will correct the reported information. Which I will do, just to see what happens.

        I am going to dig, to see if this is correct (That they can legally report the "in-between months" between filing and discharge as late or not.)

        I'll post as I find out. Anyone else actually gone through this?

          I am also having issues with Experian. Both Transunion and Equifax have all included accounts and balances show as $0 with pay status as unknown. Equifax goes further zeros out all limits and high balances displayed. Basically everything is $0.

          Experian STILL shows my mortgage as open with the full balnce and has me as over 90 days late. TU and Equifax show $0. Also many Experian accounts included in the bk show as Late 90, 120, 150 or 180 days. Also pay status shows as collection/chargeoff on many accounts while TU and Equifax simply say unknown.

          What's up with Experian? Can they be forced to change all the late dates and pay status? No wonder my Experian credit score is 120 behind TU and Equifax.

            FloridaGuy, if you read the link I posted, those are the cases against the CRA's that prove they can not report lates or charge off's after filing date. The person you spoke with at Experian is just quoting their script. Look at the actual law in the link....

              Experian is also pissing me off... They have all my accounts listed correctly except my first mortgage. My first mortgage is still being reported as open and delinquent. I submitted a dispute online and it came back as "remaining" I then reopened it again and submitted again. I'm thinking I should call or do as other say and write them instead.

              Transunion and Equifax are reporting things correctly... so I can't imagine its my lender that is refusing to say its gone...

              Orchard Bank uses Experian to pull credit report for their credit cards...and I'm pretty sure this is the reason I keep getting denied for an orchard bank card because the are showing this very negative thing on my report still.
