Our mortgage was not reaffirmed and was included in our BK and discharged 8/2005. Our mortgage company sold it to someone else named Saxon Mortgage ( also known as slimeballs).
Well in August I went to make my payment and saw that they never credited me for my July payment, it cleared our bank on July 15. Well they claim there was an ARM adjustment and yes they had the money but it would take awhile for them to post it?? Well they next thing you know someone is at my door trying to take pictures and asking me why I am late on mortgage?? I said were are not late and to please leave. I called them AGAIN and they stated we were not late and they would correct our account.
Now fast forward to 2 weeks ago, They reported us currently 30 days late on all three reports and our scores took a dive to the tune of 75 points!!!! I am also in the process of refinancing and hopefully this won;t kill that. I disputed with all three and Experian verified on ONE day that it was correct as being late. I called them and first they claimed they would fix this in five business days, then I called them back and they claim they never reported us late it was the credit bureaus, they must have gotten a sheet
I said hogwash and you have to fix this they claim they can't fix it since they didn't reported the late in the first place!!!! I told them that this account was included and legally discharged in our BK and they can not report any adverse actions including FALSE lates, they claim they are NOT in violation since they never reported the late in the first place.
What on earth can I do with them, hopefully we can refinance, but I still won't let them get away with this. What can I do????
