    student loans gone?

    I have a question...

    I just checked my free credit report with equifax .. all good debt that was paid was left as pays as agreed...
    all 4 mortgages say INCLUDED IN BANKRUPTCY

    only debt is car payment...

    I had 3 student loans from Sallie Mae that i co-signed for a friend but those also say INCLUDED IN BANKRUPTCY. does this mean that i am not liable for these student loans?

      sorry to say Nope, your credit report has ABSOLUTE NO LEGAL BEARING on the collectability of a debt. Your credit report is NOT a legally binding document.

      All that entry means is that your student loans were LISTED in your BK. Nothing more.

        so the credit reporting agency lists this as INCLUDED IN BANKRUPTCY with $0 balance reguardless if it can be included or not?

          "Included in bankruptcy" means just that....the loans are a part of your bankruptcy filing just like all your other debts. It does not mean the student loans are discharged. Student loans are discharged in bk only under very unusual and very strict circumstances. And in this circumstance since you are a co-signer, even if you did meet the strict criteria, your friend would still have to pay the student loans.

            My student loans said IIB on my credit report until after discharge then they started reporting as normal again.
            Filed: 10/26/2006
            Discharged: 03/05/2007
            Closed: 5/19/2008 - Asset case due to balance transfer and income tax refund

              they have to say IIB during the automatic stay.....then they go back to normal, though sometimes you have to request it. I had to fax Sallie Mae my discharge papers to get my loans reporting correctly.

                my bad .... i was so used to posting in chapter 7 it was just automatic... until i saw this section.

                  My student loans all say "not currently in repayment" on TU and on Experian it states "deferred" but no IIB. They are all showing positive tradelines. However, I did discover that the interest on them is still accuring so I am going to start throwing some money at them.
