    cleaning credit report

I have an account listed on my report that was opened in 11/2000. Shouldn't it be dropped by now? It does say that it was purchased by another lender though but I thought that didn't matter? Or does it.

Also I have several listings on the report from collection agencies that I had listed but the bk lawyer wanted me to list the original account and then the collection agengy underneath. I think the collection agency got overlooked. What now?

What a big mess. Oh yeah I filed 7.

It depends on the statute of limitations in the state that you created the debt in. Which state was that? And which state do you live in now? When was the last payment of any amount on this account?

Again this depends on when you filed Ch 7. If it was before Oct 2005, then as long as the original creditor was notified, even if they sell the debt to someone else, the debt is still not owed.

How much clean-up have you tried on your reports? Have you contested the debts with the credit agencies? Have you contested the debts with the original creditors and any collectors they may have sold the debt to? That's the place to start.

This website does an excellent job explaining how to go about cleaning up your credit report - http://www.allaboutcreditreports.com...ditReports.cfm . Do what it says and your credit report should improve.

I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

I guess I didn't realize there was a statute of limitations. The debt was started in Iowa. Not included in the bk which I filed in Missouri. I forgot to add it I guess. It was opened in 11/2000 and closed in 7/2002. I have not touched it at all since 2000. I don't even remember what it is for.

As for the rest the original creditor would have been notified so I guess I have a lot of work to do.

Thanks for the great website link.

Statute of limitations and how long it stays on your credit report are two different things.

Damaging information can stay on your credit report for 7 years, judgements and bankruptcy chapter 7 can stay on for 10 years, regardless of the statute of limitation in your state.

As lrprn says when was the last payment on the account? If it was before August of 2000 dispute it as obsolete.

What year did you file bankruptcy? If this debt could have been included then under old law that debt is still discharged. Try sending them a copy of your discharge papers and try disputing it on your credit report as included in bankruptcy.
