Ok, she is/was listed as an authorized user, and since has been removed from the account.

Now I need to find a dispute letter to send to the CRA... aah

Glad it turned out well for you.

An authorized user is in no way responsible for the debt but the credit card companies have decided to start reporting negative information on the AU's credit report hoping that the AU will pay the debt to avoid this.

It is a violation of the FCRA and a harsh letter to the creditor telling them this should solve the problem.

it's a violation of the FCRA?

        hmm

i guess we will start off with having her call Chase tomorrow as well as sending a letter to the CRA that has this information listed on her report.

should we just use a generic "account not mine" dispute letter?

Since you are not married, it is in violation according to recent cases. A married couple in a community property state is the only time it is allowed.

The section of the FCRA that addresses this is open to interpretation but when challenged, the debtor is prevailing.
In essence, you are writing to the creditor telling them that since you are not liable for payment and did not sign an agreement, you want all the account information removed from your credit report.

            alright.

from asking questions at another forum, some people seem to suggest that disputing using a free credit report is not as strong as disputing using a paid for credit report.

the only CRA that the Chase account is reported on is Transunion.

My original plan was just to send a dispute letter to TU like this:

            Sample Dispute Letter

            Date:

Regarding: Put Credit File # (Found on Credit Report)

            Credit Bureau
            Street Address
            City, State, Zip

            Dear Reviewer:

I recently received a copy of my credit file. This report lists the following items that are in error. These items are in error because of the reason listed. Please verify the following items and update my credit report to accurately reflect my actual credit worthiness. Upon reading the info included in the credit file packet I received from you, I expect you to conclude this process in the 30 days allowed under the FCRA. Thanks for your help in making my file reflect my true standing.

Item-# Account Name Reason Of Dispute

            1)

In closing, please send me my free updated copy of my file as soon as you have completed the corrections.

            Respectfully,

            Your Signature

            Name
            Address
            City, State, ZIP
            Social Security Number
            Date of Birth

with the reason being "not mine"

i'm not sure how to word the FCRA thing or if that would/will help me

Sorry if I seem overly cautious, but the last thing I want is the dispute to be rejected and she is stuck w/ this negative mark on her report for the next 7 years

If it is only TU, I would go online and pull a TU credit report, the cost is nominal for one credit bureau. Then dispute it online as...I am only an authorized user on this account and am not responsible for this debt. Please remove all information about this account from my credit report according to FCRA guidelines.

Disputing online is a lot quicker than writing to them.
