    Need some advice on leaving a ride thru

    Hi!
    My husband filed BK& and was closed in March 2011. We currently are doing a pay and stay with Bank of America........this is my question.since the house was included in HIS BK........if we decided to walk away because it is very costly still for us........What is the proceedure of the bank? Do they start a foreclosure like if we still owned the property? Is the time frame much shorted? Do we have a few months to save up to move out?

    Bank od America only told me..they take action after 90 days late. They did not say what kind of action. So would it be a foreclosure? Or do they just litterally make us move immediately? We live in Cleveland Ohio, I do not know how long this takes? I do know this is a judicial state.
    We need about 6 months to save up for moving and rent in a new place.
    We are retired and on a fixed income. This is so important for us to know.

    Please if anyone has any insight to this Please help us with some info;;;;;;;

    Once you stop paying, you probably have a period in time that is measured in years and not months....so save away. I have heard 12-18 months before the foreclosure procsess even begins in Ohio. Once it is in motion you still have 2-3 months. So don't worry about the knock on your door. He might have the loan in his name, but you are likely on the deed with him.

      Hopefully you are not on the mortgage. It does not matter if you are on the deed. It will be repoed. It is a longer experience than you think. Three months of defaults, then dunning action, then legal stuff, and if you refuse to leave, they have to sue you for your removal by Sheriff. (a minor suit). That would take another month. As many houses in this state, they have their hands pretty full so you will be at the end of the line. I'm with "dspii" in that you will have plenty of time to save up. 'Hub
