    Confused on 3 year date can someone help

    Our Chapter 7 was discharged feb 2008. we walked away from the house, the bank dragged their feet, a lawyer friend took them in court forced them to take house back and transfer deed to them the bank November 09. The bank sold the house straight away and the new owners closed 30th Jan 2010. When will our 3 year date be and when could we close on a new home? thanks so much.

    March of 2013 via FHA, 2014 for conventional, which no one really does. As an fyi 3 for fha plus a month from date of change of Deed.

    Other options such as lease purchase, owner financed, etc etc have no bearing with BK however.
    3/2/09- Filed: chapter 7 / No asset
    4/1/09- 341 Hearing: 1 creditor showed up Got to love family feuds
    4/2/09- Trustee Report of No Distribution Filed
    6/24/09- Discharged and case closed

      just asking....how did you force the banks hands...we are in the same situation....the bank has been dragging their feet for almost 3 years as well....and the odd thing is they have PMI...and it's an FHA...so we think there MUST be a document problem and that's why they can't foreclose....we too, wanted out name off the deed, however, really don't care much anymore....

      we just purchased another house...however, it was owner financing...we close next month....people are as desperate to sell as those to buy....we just found someone OTHER than a bank to work with us.....

      also....can you tell me what the atty did to force the banks hand to foreclose????

        Tobee, I find this amazing. If you didn't move, could you still be living in your old house? I noticed a few around here being sold after sitting empty for years for 1/10th the original loan amount, financed by a bank to a flipper and the new owner gets a loan through the flipper's bank.

          mijd, actually ...i'm not certain?? i mean, maybe the bank would have acted quicker if i was living on their dime??? i just don't know...and actually, i guess it's still "living" on the bank at this point. i have no clue. we have attempted certified letters...calling their atty's nothing...it's listed as "active" and all...but no movement at all.

          our problem and why we left was our utilities were running over $1100 monthly...shoot, that about what it cost us for everything here in our new house...so, it just didn't make good sense to stay. oh, and we had all the rooms closed off except 3....and it still cost that much to heat and light...so we could no longer even afford that...after 33 years it was a hard choice, but our only one.

            I've read in your other posts that you love Florida... I do too. I use to get home sick but only about a year or so after moving. There is nothing like being on the beach in Feb or wearing shorts on Christmas Eve.... (not this year tho)

            I'm wondering if your bank is paying the property taxes on your old house. If not it seems the countyor city whichever is the case could sell it in a tax sale and the lienholder would be SOL. ..... I can understand those high utility bills. Yikes.

              you got that with the utility bills...we only had one really large one since we lived here it was 339 for electric because we had visitors using the pool, using more lights etc. this month it $115...LOL!! both heat and electric...works for me!!

              i'm not quite sure if i LOVE florida as much as i love being here and away from all the terrible things of the past...and also, being from san fran, of course i would had rather gone out there....but WAY to expensive for us and besides the most important deciding factor was that my husband wanted to be here...so that really was the reason, plus the failing housing market...cheap housing to rent etc.

              yes, chase would never let it go for taxes....the house use to be 100's of thousands of dollars...USE TO!! LOL!!! i'm sure they are hoping that they will fetch more than a tax lien....we actually know they have insurance on the property and do pay the taxes...or at least someone is???

              it was ridiculous.....the utility bills and we were either freezing or soooooooooooo hot!! we could no longer afford to be cold or HOT!!

              but what's UP with this weather here!!! HOLY cow....first year it froze...second year it was FROZEN here for what ...i think 18 days or so...and NOW tonight!!! it's going be in the 20's!! and i thought i was leaving that!!! well, at least NO snow to shovel...

                I remember when I left the frozen north for Florida in Jan of '85, I crossed the state line about 11pm driving to Tampa. I kept sticking my head out the window waiting for the air to be warm..... it never happened. The next few days after I arrived the lows were in the high 20's. I can only remember one year after that maybe 93 or 94 when it got as cold as it has been this winter and last, but the cold never stuck around like it has this time.
                I can't complain too much as I was in NYC during the holidays and had to walk through almost 2 feet of snow. Now that is cold.
                Also I would love to live in SF. Could never afford it tho. I see some of those Painted Ladies were going for well over a million.
                Cheer up it will get warm again soon. (I hope).

                    Never been to Cape May but I have a coworker who loves it and goes there as much as he can. He's originally from NJ. He says it is quite possible they may have more painted ladies than SF.

                    I've read in the paper the highs will be back in the low 70's Monday and Tuesday...... then again the low was to be 46* last night and on my way to work it was 34*. So much for newspaper weather accuracy. Funny about Florida in the winter, I've seen the temp to be as much as 10 to 12 degrees warmer 75 to 90 miles south of where I live. Crazy.

                    I love the summer tho, heat and humidity!

                      well...it's not so much that i'm crazy about the heat and humidity while my other half is....i just hate the freezing COLD...it was 24 degrees here this morning!!!!!! we put up a pump green house tent to save some plants...just wondrous experience moving to the warm...LOL!!!!!!

                      i heard on the weather tonight next week will hit 80...i'll believe it when i FEEL it...LOL!!! until then....i have my silk underwear on and i'm still freezing!!
