    Foreclosure Not showing as public record on credit report

    Hi,
    I know there are tons of questions and answers out there regarding foreclosures and credit reporting, but I wanted to detail my situation and let the feedback begin.

    My wife and I filed chapter 7 bankruptcy in April 2009 (discharged July 2009) and included the property. We did receive a few foreclosure notices, but nothing else. In mid 2008 we decided to move out before they slapped a foreclosure sign on the lawn. The house remained vacant for months. Anyways, currently both my wife and my credit report only show the bankruptcy under the "Public Records" section, and where our mortgage is listed it notes "Included In Bankruptcy". Nowhere is it noted as a foreclosure.

    I called the bank where our loan was held and asked if the property was foreclosued on and the sale date , they responded "Yes, October 2008". My question is, seeing as this isn't noted under public record, does this mean we can buy at the 2 year period? If we need to wait 3years, is it 3years from the sale date (Oct 2008) or 3 years from the discharge date seeing as we included the home in the bankruptcy.

    Please let me know your thoughts.

    I worked with BK Home Buyers & Refinance scenarios. The usual time starts when it becomes public record at the courthouse.(default sale takes place)

        Its exactly when the foreclosure was completed on. Usually the default sale date. You can go to or call the courthouse and get info on your property. Just remember this is the date that any mortgage lender will go by.

          lots of counties have these kinds of records online now. I would check that out. If not as afterbk said go to the courthouse and find out the date

            I thought that if you were foreclosed on and filed bankruptcy that the Bankruptcy takes precedence and the Foreclosure doesn't show.

            Am I correct in this thinking ?

              Nope. Both show up.

              However, when a BK and foreclosure happen around the same time, during a "subjective" review of your credit, the underwriters understand what happened.
