I feel sorry for anyone dealing with chase. I support credit unions only and shall the rest of my life. Been with mine for more then 30 years and they will be the first to get my money and business. God Speed to all

Chase Mortgage after discharge

Hello All,
I currently am 9 days away from discharge (ch 7), and am surrendering my house which has a 1st mortgage with Chase. My 2nd is with Suntrust. Both mortgages are included in the BK.
It seems that my situation is similar to several of you, but it sounds like one difference is that I have not been making payments during the BK process. Does anyone know if Chase will consider working something out with me after discharge, or would I have had to keep making payments during the BK in order for them to consider? Also, if Chase was to do something at that point, what percentage of principal on the 2nd mortgage with Suntrust could I expect to settle for?

I tried to make my Chase Mortage Payment though the just in time system like i do every month. But this month it would not process my payment. It just stated call back during business hours. Iam really confused. We had to file chapter 13 because of ID theft and we been paying our mortage and are not behind on it nor have we ever been. We just could not afford to pay all the credit card charges that we did not make and they also wiped out our checking account. Are we going to lose our house. the court just told us to continue to make the payments. They did say anything about them not taking them. In the morning I am going to mail my payment into chase. Which is going to make my payment late.

I am 1 year post discharge Ch7.
Re-affirmed Chase home loan thru lawyer in 30 days prior to due date, Chase claims they did not receive *coughBScough*.
During BK I was locked out of online access, after BK, regained online access. Name is still on the title but shows IIB on credit report. Not showing credit of ontime payments.
Spoke to chase today, they suggest I wait until my 2nd year post BK before Chase will consider a re-finance. Doing a loan modification w/chase does -not- reaffirm you, as they say modifications keep same loan #. Unless you refinance and get a new loan # they cannot help you reaffirm the loan....ever... (in their words)
Anyone else out there 'post' BK a year or two and have been able to do something different then Chase explained to me today?Don't take my word for it, I'm just sayin'

Questions about your process in getting a Loan Mod.
Thank you Nurse. I am entering the mortgage modification process myself next month. I am worried about blowing it and since I have a chase loan with Wells Fargo investor I am going to ask some specific questions:
Did you eliminate all luxuries: cable, internet, cell etc?
Did your bank statement totally line up with just your income? (I buy stuff for work and get reimbursed constantly and I am afraid of what all the deposits look like.)
What was the tenor of your hardship letter? Did you do the mod yourself?
What percentage of your income did your final payments 5-25 end up being? I will request that in my letter since it is the same bank/investor combo. I am grateful for any response i get from you. Bless you.

WC Nurse: Your threads have lifted our spirits. I don't blame you if you are all set and don't return to these forums. If you do read this, did you stay current on your first discharged mortgage? Also the chase home value calculator shows me as having no equity but not underwater. Zillow and all the other calculators show me as way under water. So who knows.... I am staying current as long as I can but I am one disaster away from missing a payment. I also wonder if that will even hit my credit as the mortgage was actually discharged....
Any comments from other folks are welcome....

while working on our loan mod with chase ...or RIGHT in the middle we were served with foreclosure papers....when we applied for the loan mod one of us still had our job...by the time we were served both of us were laid off, so really the loan mod would not have helped us...so we swallowed our pride, tears....fears....and called our atty who advised us to lock and leave it after 33 years....instead i called chase....pleading with them...no no avail.....
we filed bk....surrendered...have been discharged....we moved 1700 miles away.....and guess who comes a callin? CHASE!!!!! they want to know what are intentions are...now, mind you it's almost 3...YES...that is THREE years later.....2.9 months to be exact....what do you mean i asked....they said OH...you re-opened your loan mod and we wanted to know what your are going to do now......what????????? who re opened what??? you did chase said...i said no way....you have our discharge....you were listed in the chapter 7 never responded even then when our atty tried to work with you...and now you want what???
chase STILL has not even begun to foreclosure on the house....and it's really dumb...we were FHA with PMI ...when i called FHA they said chase hadn't even put a claim in because they MUST follow the process of the sheriff's sale first and then collect on the balance if the house sells....
we are suspect that when we refin'ed back in 2007 it was with a shady company.....chase was just servicing our mortgage, however, approx. six months into the refin we get notice from chase they purchased our mortgage....we now have a feeling that they cannot foreclose, because of some document glitch since it makes absolutely no sense.....
as from what i understand there is a statue of limitation on most everything except murder......so our next step ...well i have a few...i can continue to go to the agencies in dc....and file complaints ...or simply wait it out and see what or where the law stands on the statue of limitations in respect for this type of situation and hopefully at some point get a court order to get our names off the deed...not that i'm really concerned about it...it's just i never want anything to do with them again..

I owe 150K on a townhome that is now maybe worth 50k. I have stopped paying on both my 1st (with Chase) and 2nd (a credit union). The last payment to Chase was one year ago. I got served foreclosure papers at the end of August but in Florida foreclosures are so backed up who knows how long it will be. The last time I pulled my credit (after the foreclosure notice) both mortgages say discharged in Ch 7 BK and my score was over 630. I am not expecting this foreclosure to show up on my credit report since I never reaffirmed either mortgage. I am hoping to be able to buy something in the next year, maybe through the USDA program.
As for your note about Chase buying mortgages and being in some shady deals, that is the case with my mortgage. It has been sold three times and I don't think Chase can prove they own the note. They are being accused of forging doc's in the state of FL (and nationwide), and I think they forged a doc in my case saying the purchased the loan directly from my original lender. Not sure how they got that document, since I paid GMAC for over a year before it was sold to Chase. So I am challenging their ownership and will probably drag this out for another year.

we are in in florida now............we JUST........THIS MORNING!!!!!!!!!!!!!! got the contract in the mail signed and we are buying the house we have been renting with the owner financing the mortgage........so i'm not going to even have to concern ourselves with using another bank....we are pretty much in the sticks but don't know if USDA would consider us rural enough....but this person is giving us 5% no closing fees and i'm doing all the legal prep work....so we are good to go other than a title company!!!!!!!
