In Feb 2006, I bought a house with my then girlfriend - to get the best rate, only she was on the notes (1st and 2nd), but the mortgage and deed are joint. I left in March of this year, she filed for Chapter 7 this summer, and has recently been discharged. She did not reaffirm the mortgages, but 'intends' to pay so she can keep the house...what does all of this mean for me, especially if she doesn't pay? I would like to get my name off the deed and am not sure whatt, if anything, needs to be done with the bank regarding the mortgage...I did not file and would like to purchase a home soon - will this affect me?

OP I have a home loan where I signed the promissory note, mortgage and deed but my DH didn't want to sign because he had not yet filed BK. But my lender said that while DH didn't have to sign the promissory note, he must sign the mortgage and deed because they said he had ownership rights because we are married. So as I understand it, DH has 50% ownership rights but is not under any obligation to pay the promissory note. So I would think you have ownership too but no obligation to pay. And if your GF were to agree, you should be able to file a Quit Claim on the property if you want your name off the deed. But an asset without any liability is not 'necessarily' a bad thing to have in my opinion.
