i do not understand the wrath of judgment against people who file a chapter 7 instead of a 13. i believe that most people who do file chapter 7 did intend to pay off their debts in the beginning. i worked extremely hard for almost 30 years and had excellent credit up until 4 years ago when i lost MY 60k job. circumstances prevent these folks including myself to not be able to qualify for a chapter 13 even if we wanted too. the job i found barely covers my basic expenses and i lost the house and 30k car. the past few years have been an eye opener for me. i may one day get back to the point of getting another job with more money, but if i do, i will not put myself in the position again of losing anything if that income were to be lost again. anything can happen in these crazy times that limit your income in an instant. job loss either by layoff or medical emergency. and then where will you be?

I don't think it should be judgmental, as it's just a mere fact. Chapter 13 debtors have it harder, are under the control of the Trustee longer, and in most cases, pay back between 10% and 30%. Circumstances are controlling, but some people are, indeed, "forced" into a Chapter 13 in order to get the protection of the Court. The majority of filed Chapter 13s fail, never reach confirmation, or are converted to a Chapter 7.Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
