    CH 7 car question

    I am filing my Ch 7 next tuesday. I have a 2004 Ford Explorer that I owe about 6800k on. My payment is 575.00/month and it is killing me! I am 3 months behind on this loan and have absolutly no way to get caught up. I only have 8 months left to pay. The loan is with a credit union that I have no other accounts.

    Has anybody every heard of a credit union modifying a loan during BK. I am not going to be able to hang on to this car if i have to get caught up.

    Also this is my only means of transportation. there are no bus lines where i live and i have to get to work everyday. If i lose this car how do i get a new one? I have no money to put down and will not be able to save any. This BK is not going to free up any money for me it is just to stop the lawsuits and judgments. I have taken a 30k paycut due to a layoff and have not paid a dime on my CC since feb 07.

    Any help would be appreciated.

    Yes. I modified my car loan with my CU in the BK. I spoke directly to the BK dept. Got it in writing, signed by the CU and recorded with the court (reaffirmation).

    I reduced the monthly payment by about $100 mth by just stretching out the payment period two additional months. You may want to stretch a little longer to get to a payment you can afford. My CU was very, very cooperative. Not all of them are that way, but it is worth trying.
