I am in Texas, filed Chapter 7 & was discharged 12/2005. We didn't reaffirm our mortgage but continued to make payments & were allowed to remain in the house. My spouse recently had to take a $10K pay cut at work by moving to another dept as his dept was being phased out or be completely without a job. This caused us to fall 2 mos. behind. We called the lender who offered us a repayment plan with 3 slightly higher pymts & 1 balloon pymt. We've made the 3 slightly higher pymts but can't afford the balloon pymt as my spouse has had some recent medical issues. We just called the lender again who advised that they may be able to do a loan mod & add the missed pyts to the end of the note but with the economy worsening everyday & the medical bills stacking up now, we are considering simply leaving the house & moving w/relatives until we can find a more affordable place to live. Can the lender attempt to come back against us for the unpaid balance? It shows a 0 balance due to discharge on our credit report but we're not sure how signing the repayment agreement affects us.
