I feel so much better now after talking to a few more attorneys. One I spoke to on the phone earlier this week (have actual consultation scheduled for next Wed), the other I had the consultation over the phone yesterday.
Both attorneys think that everything sounds fine - obviously I haven't given them actual paperwork yet - and don't see any issues that the Trustee might take with our case. They also both said that they have not seen any audits in our area in the time that they have been doing them.
Two things that they feel will be fine for us that make a huge difference in our situation:
1) tithing is ok as long as it's something we've been doing for a while
2) looks like we should be able to claim DD as part of our household.
I have the means test set up in Excel and changed the numbers to a 4 person household instead of 3. We have a magic window between April 24th and May 1st where we will be under the median by $75!!! Even if they take it further and go through the means test we are negative $771 per month, and on Schedule I/J we are negative $543 per month.
The attorney that I had my consult with yesterday told me that there's only one BK judge for our county, and he is a conservative Christian and therefore is very unlikely to take issue with our tithe, even without the law in place to protect us. When I asked him if we would be scrutinized harder because of our high debt load, he said it actually causes them to be less likely to challenge us on filing, as it makes sense to them that we would file.
All in all, I'm feeling pretty good now! Looks like DD may be moving back in with us for a few months while she decides what to do. She's been unable to get a job here, and we can't afford to keep giving her money. Plus, if we're going to be paying for her to live, it might as well work in our favor!
Now I'm trying to decide which one to hire - will post that in the forums to see what opinions others may have. My only big concern now - other than which attorney to hire - is whether or not we can hold off lawsuits until the end of April. That's 3 1/2 months down the road...
